EXPANDED TERMS OF ENGAGEMENT, SERVICE DISCLOSURE, AND USER RESPONSIBILITY AGREEMENT

This Expanded Terms of Engagement, Service Disclosure, and User Responsibility Agreement (hereinafter, the “Agreement”) constitutes a legally cognizable and binding understanding between StudyPlans (hereinafter referred to as “StudyPlans,” “the Company,” “we,” “our,” or “us”) and any individual, group, or entity who elects to access, browse, utilize, register with, or otherwise interact with the StudyPlans platform in any capacity whatsoever (hereinafter collectively referred to as the “User,” “Users,” “you,” or “your”). Such Users expressly include, without limitation, students, prospective students, parents, guardians, educational advocates, or any other persons acting on behalf of or in the interest of a student.

1. Purpose, Scope, and Nature of Services

StudyPlans is, in its essence, a facilitative, technology-enabled marketplace designed to bridge the informational and logistical gap between Users seeking guidance in the educational admissions process and independent admissions counselors (hereinafter “Counselors”) who offer advisory, consultative, and strategic services. The platform allows Users to search through, evaluate, compare, and ultimately select from a broad and diverse array of Counselors based on criteria that may include, but are not limited to, experience, specialization, pricing, communication style, and perceived compatibility with the User’s individualized academic and admissions objectives.

It must be stated with particular clarity—and repeated for emphasis—that StudyPlans does not itself provide admissions counseling services. Rather, it provides the digital infrastructure through which such services may be discovered and engaged. Any and all substantive advice, recommendations, or guidance are provided solely by the independent Counselors and not by StudyPlans.

2. Independent Status of Counselors and Absence of Agency Relationship

All Counselors made available through the StudyPlans platform operate as independent contractors or independent service providers. Under no circumstances shall any Counselor be deemed to be an employee, partner, joint venturer, agent, or legal representative of StudyPlans. Accordingly, StudyPlans disclaims any and all responsibility for the conduct, communications, qualifications, representations, or professional performance of any Counselor.

Users are hereby advised that any agreement entered into with a Counselor—whether formal or informal, written or verbal—is a separate contractual relationship to which StudyPlans is not a party. StudyPlans neither controls nor directs the manner, method, or substance of the services provided by Counselors.

3. Absolute Disclaimer of Admissions Guarantees

In the interest of eliminating any potential ambiguity, misunderstanding, or misplaced reliance, StudyPlans hereby issues an unequivocal and emphatic disclaimer: admission to any college, university, or educational institution is not guaranteed under any circumstances.

Admissions decisions are inherently subjective and are determined exclusively by the institutions to which a student applies. These decisions are influenced by a wide array of factors, including but not limited to academic performance, extracurricular involvement, institutional priorities, applicant pool competitiveness, and other considerations that are entirely beyond the control or influence of StudyPlans or any Counselor.

No statement, representation, or implication made by any Counselor shall be construed as a promise, warranty, or guarantee of admission.

4. Absolute Disclaimer of Scholarships and Financial Aid Guarantees

In a manner parallel to the foregoing, StudyPlans further disclaims any guarantee or assurance regarding the حصول (or receipt) of scholarships, grants, financial aid packages, or any other form of monetary or merit-based assistance. Scholarships and financial aid are not guaranteed and remain subject to the independent determination of the awarding institutions or organizations.

While Counselors may provide guidance, suggestions, or strategic advice intended to improve a User’s prospects, such guidance does not and cannot ensure any particular financial outcome.

5. User Responsibility, Due Diligence, and Assumption of Risk

Users acknowledge and agree that they bear sole and exclusive responsibility for:

  • Evaluating the qualifications, credentials, and suitability of any Counselor;
  • Reviewing all available information, including profiles, reviews, and stated areas of expertise;
  • Determining whether a given Counselor aligns with their specific goals, expectations, and financial considerations.

StudyPlans may provide tools, filters, and informational content to assist Users in this evaluative process; however, such tools are provided for convenience only and do not constitute endorsements, certifications, or guarantees of quality or outcome.

By engaging with any Counselor, the User knowingly and voluntarily assumes all risks associated with that engagement.

6. Communication, Complaints, and Issue Resolution Protocol

By accessing or using the StudyPlans platform in any manner, the User hereby affirms that they have read, understood, and agreed to be bound by the terms and conditions set forth in this Agreement. The User further acknowledges that they understand and accept the fundamental uncertainties inherent in the admissions and financial aid processes, including the explicit and repeated disclaimers that admissions and scholarships are not guaranteed.


PRIVACY POLICY

This Privacy Policy (hereinafter referred to as the “Policy”) is intended to describe, in a thorough, detailed, and unavoidably extensive manner, the ways in which StudyPlans (hereinafter “StudyPlans,” “the Company,” “we,” “our,” or “us”) collects, uses, processes, stores, shares, and otherwise handles information obtained from individuals who access or use the StudyPlans platform (hereinafter collectively referred to as “Users,” “you,” or “your”), including but not limited to students, parents, guardians, and admissions counselors.

By accessing or using the StudyPlans platform in any capacity, you acknowledge that you have read, understood, and agreed to the practices described in this Policy.


1. Scope and Applicability

This Policy applies to all information collected through:

  • The StudyPlans website and platform;
  • Any associated communications, including email correspondence;
  • Interactions between Users and Counselors facilitated by the platform;
  • Any other services, features, or content made available by StudyPlans.

This Policy does not apply to information collected directly by independent Counselors outside the StudyPlans platform, as such parties operate independently and maintain their own privacy practices.


2. Categories of Information Collected

In the course of operating the platform, StudyPlans may collect various categories of information, which may include, without limitation:

2.1 Personal Identification Information

Information that may be used to identify an individual, including but not limited to:

  • Full name;
  • Email address;
  • Phone number;
  • Mailing address;
  • Account login credentials.

2.2 Student and Academic Information

Given the nature of the services provided, Users may voluntarily provide:

  • Academic history;
  • Test scores;
  • Extracurricular activities;
  • College preferences;
  • Application materials or drafts.

Users are advised that submission of such information is voluntary but may be necessary to fully utilize the platform.

2.3 Payment and Transaction Information

Where applicable, StudyPlans may collect or facilitate the collection of:

  • Billing details;
  • Transaction histories;
  • Payment method information (processed through third-party payment processors).

StudyPlans does not necessarily store full payment card details and relies on secure third-party providers where appropriate.

2.4 Technical and Usage Data

We may automatically collect certain information regarding device and platform usage, including:

  • IP address;
  • Browser type;
  • Device type;
  • Pages viewed;
  • Time spent on the platform;
  • Referral sources.

2.5 Communications and User-Generated Content

Any messages, reviews, feedback, or other content submitted by Users, including communications with Counselors through the platform, may be collected and stored.


3. Methods of Information Collection

Information may be collected through a variety of means, including:

  • Direct submission by Users via forms or account registration;
  • Communications between Users and Counselors;
  • Automated technologies such as cookies, log files, and analytics tools;
  • Third-party integrations and services.

Users may control certain data collection mechanisms, such as cookies, through browser settings, though doing so may impact platform functionality.


4. Purpose and Use of Information

StudyPlans may use collected information for a variety of legitimate business purposes, including but not limited to:

  • Facilitating connections between Users and Counselors;
  • Providing, maintaining, and improving the platform;
  • Personalizing user experience and recommendations;
  • Processing transactions and managing accounts;
  • Communicating with Users regarding services, updates, or support;
  • Monitoring and analyzing usage patterns;
  • Enforcing terms, policies, and applicable laws.

Notwithstanding the breadth of the foregoing, StudyPlans endeavors to use information only to the extent reasonably necessary to operate and enhance its services.


5. Sharing and Disclosure of Information

StudyPlans may share User information under the following circumstances:

5.1 With Counselors

Information may be shared with selected Counselors to facilitate advisory services. Users control, to a significant degree, what information is shared through their interactions.

5.2 With Service Providers

We may engage third-party vendors to perform functions such as payment processing, data hosting, analytics, and customer support. Such providers are granted access only to the extent necessary to perform their services.

5.3 For Legal and Compliance Purposes

Information may be disclosed where required to:

  • Comply with applicable laws or regulations;
  • Respond to lawful requests from authorities;
  • Protect the rights, property, or safety of StudyPlans, Users, or others.

5.4 Business Transfers

In the event of a merger, acquisition, restructuring, or sale of assets, User information may be transferred as part of the transaction.


6. Data Retention

StudyPlans retains personal information for as long as reasonably necessary to:

  • Fulfill the purposes outlined in this Policy;
  • Comply with legal obligations;
  • Resolve disputes and enforce agreements.

Retention periods may vary depending on the nature of the data and applicable legal requirements.


7. Data Security

StudyPlans implements reasonable administrative, technical, and organizational measures designed to protect User information against unauthorized access, loss, misuse, or alteration. However, no system can be guaranteed to be completely secure, and Users acknowledge that they provide information at their own risk.


8. User Rights and Choices

Depending on applicable law, Users may have certain rights, including:

  • Accessing their personal information;
  • Requesting correction or deletion;
  • Opting out of certain communications;
  • Managing account preferences.

StudyPlans will make reasonable efforts to respond to such requests in accordance with applicable laws.


9. Communications and Issue Reporting

If Users have questions, concerns, complaints, or disputes related to privacy, data handling, or interactions with other Users—including counselors, advisors, students, or parents—they are encouraged to contact StudyPlans at:

While StudyPlans may review and respond to such communications, it does not guarantee specific outcomes or resolutions.


10. Children’s Privacy

StudyPlans may be used by students under the age of 18 with the involvement of a parent or guardian. We do not knowingly collect personal information from children without appropriate consent where required by law. Parents or guardians who believe that information has been collected improperly are encouraged to contact us.


11. Third-Party Links and Services

The platform may contain links to third-party websites or services. StudyPlans is not responsible for the privacy practices of such third parties, and Users are encouraged to review their respective policies.


12. Updates and Modifications to This Policy

StudyPlans reserves the right to modify, update, or revise this Policy at any time. Changes will be effective upon posting to the platform, and continued use of the services constitutes acceptance of such changes.


13. Acknowledgment and Acceptance

By using the StudyPlans platform, Users acknowledge that they have read, understood, and agreed to this Privacy Policy. Users further acknowledge that data transmission over the internet carries inherent risks and that StudyPlans cannot guarantee absolute security.
